HIPAA Notice of Privacy Practices

Florida Service Animals ("we," "us," "our") is committed to protecting the privacy of your health information. As a healthcare-adjacent service operating in Florida, we comply with the Health Insurance Portability and Accountability Act (HIPAA) and Florida's Confidentiality of Medical Information Act (CMIA). This Notice describes how your health information may be used and disclosed and how you can access this information.

2. Information We Collect

As part of the Florida ESA and PSD evaluation process, we collect:

  • Personal identification information (name, email, Florida address)
  • Mental health history and symptom information provided during evaluation
  • Telehealth session records with Florida-licensed clinicians
  • ESA or PSD letter documentation
  • Payment information (processed by secure third-party processors)

3. How We Use Your Health Information

Your health information is used to:

  • Conduct HIPAA-secure telehealth evaluations with Florida-licensed clinicians
  • Generate your Florida ESA or PSD letter
  • Communicate with you about your evaluation status and letter delivery
  • Process payments securely
  • Comply with Florida law and HIPAA requirements

We do not sell your health information. We do not share your health information with Florida landlords, employers, or third parties without your explicit consent.

4. Permitted Disclosures

We may disclose health information as permitted by HIPAA:

  • Treatment: To Florida-licensed clinicians providing your evaluation
  • Operations: To service providers supporting our HIPAA-secure telehealth platform
  • Legal requirements: When required by Florida law or valid court order
  • Authorization: When you provide explicit written authorization

5. Florida CMIA Protections

Florida's Confidentiality of Medical Information Act (CMIA) provides additional privacy protections beyond HIPAA for Florida residents. We comply with both HIPAA and CMIA requirements for all Florida Service Animals clients.

6. Your HIPAA Rights

You have the right to:

  • Request access to your health information we hold
  • Request corrections to inaccurate information
  • Request restrictions on certain uses and disclosures
  • Request a list of disclosures we have made
  • File a complaint with HHS Office for Civil Rights if you believe your rights were violated

7. Security

All telehealth evaluations are conducted through HIPAA-secure, end-to-end encrypted platforms. Florida Service Animals uses industry-standard technical, administrative, and physical safeguards to protect your health information.
