ESA — FHA + Florida FHA Housing
An ESA provides emotional and psychological support. Florida residents with ESAs are protected in housing under the FHA and Florida Fair Housing Act. No public access rights. Requires a Florida-licensed clinician letter.
PSD — ADA + FHA + Florida FHA
A Psychiatric Service Dog is trained to perform specific tasks mitigating a psychiatric disability. PSDs have full ADA public access rights plus FHA and Florida Fair Housing Act housing rights in Florida.

Does Florida have any service animal laws beyond the ADA?
Yes. The Florida Fair Housing Act (Fla. Stat. § 760.20 et seq.) provides state enforcement of housing accommodation rights through the Florida Commission on Human Relations. Fla. Stat. § 413.08 (2022) adds Florida-specific ESA documentation requirements unique to this state.
Can Florida businesses deny a PSD or service dog?
Only in very limited circumstances — if the specific animal poses a direct threat. Florida businesses may ask only two questions: (1) Is this a service animal required for a disability? and (2) What task has it been trained to perform?
What documentation does a Florida ESA need?
A signed letter from a Florida-licensed mental health professional (LP, LCSW, LMFT, LMHC, or psychiatrist) confirming your disability and the ESA's therapeutic role. The clinician's Florida license is verifiable at flhealthsource.gov.
Are vests or ID cards required for Florida service dogs?
No. The ADA does not require service dogs to wear vests, patches, or carry ID cards. These are optional products. Demanding them from a service dog owner is not permitted under federal law.
